Doing business with the Far East District

Contracting Division awards and administers contracts in support of the Department of Defense Construction Program for U.S. Forces in Korea. We issue contracts for construction, architect-engineer design and other engineering services, repair and maintenance service contracts in support of USFK facilities, and supply and service contracts in support of Far East District operations.

Our contracting activity is based on the Federal Acquisition Regulation (FAR), Department of Defense FAR Supplement, Department of Army FAR, USACE Acquisition Instruction, and the U.S. Forces Korea Regulation 700-19, which implements the Status of Forces Agreement (SOFA) existing between the U.S. Government and the Republic of Korea.

SOFA requires District construction work in Korea to be performed by Korean construction contractors. Most of the applicable regulations relevant to construction contracts are in Parts 15 and 36 of each of these sets of regulations. Part 52 contains the Contract Clauses and Special Clauses. The FED construction program is contracted through competitive negotiation with prequalified Korean construction contractors. Contractors for specific projects are selected through prequalification procedures IAW DFARS 236.273. The prequalification panel meets periodically to review and update the prequalified contractor list in accordance with PODR 415-1-17 and Construction Prequalification Eligibility Requirements. (Companies may apply to become prequalified construction contractors by filling out the Application Form)

These contractors submit competitive proposals for U.S. made off-shore material to be provided under the contract as contractor-furnished materials. We cannot disclose the names of successful contractors nor their competitors. A list of Korean military construction contractors may be obtained from Korean Military Contractors Association, #538, Dohwa-Dong, Mapo-Ku, Seoul, Korea.

Far East District issues solicitations to U.S. contractors for supplies or services pursuant to conditions set out in the SOFA. When SOFA criteria for CONUS purchases are met, solicitations are published via Federal Business Opportunities or the Army Single Face to Industry. Small Business Programs don't apply to Far East District procurements. Contractors solicited by these means must be registered in the System for Award Management.
