§401 Certifications: Dredge & Fill

§401 Certifications of Nationwide and Regional General Dredge and Fill Permits

Nationwide General Permits

DEQ has certified with conditions the majority of the 2012 Army Corps of Engineers Nationwide Permits (NWPs) authorizing the discharge of dredged or fill material associated with general types of activities such as aquatic habitat restoration, establishment, and enhancement and residential, commercial, and institutional developments.

DEQ partially certified the following three NWPs: NWP 12 (Utility Line Activities), NWP 13 (Bank Stabilization), and NWP 14 (Linear Transportation Projects).

DEQ has denied the following four NWPs: NWP 16 (Return Water from Upland Contained Disposal Areas), NWP 17 (Hydropower Projects), NWP 51 (Land-Based Renewable Energy Generation Facilities), and NWP 52 (Water-Based Renewable Energy Generation Pilot Projects). DEQ will provide individual §401 certifications for activities authorized under the NWPs that have been denied on a project-by-project basis.

The 2012 certifications will expire on March 18, 2017.

Regional General Permits

DEQ has certified Regional General Permit–Idaho (RGP-I) authorizing the construction, repair, or replacement of non-commercial piers and floating docks for a joint-use pier or floating dock, marine launching rails, mooring piles, and portable boat lift stations.

DEQ has certified Regional General Permit 27 authorizing the addition of piers and floating docks, marine launching rails, mooring piles, and portable boat-lift stations in Lake Pend Oreille and Pend Oreille River.

DEQ has certified Regional General Permit–Management of Aquatic Invasive Species (RGP-AIS) authorizing the discharge of fill material, structures, and/or work associated with the placement of temporary benthic (bottom) barriers, mechanical harvesting, raking, pulling by hand, and divers using vacuum suction to control growth of invasive, noxious aquatic vegetation as designated by the Idaho State Department of Agriculture and usually associated with docks and swimming areas for safety and navigation purposes. The RGP-AIS also authorizes discharge of fill material, structures, and/or work associated with the placement of temporary benthic barriers and/or divers using vacuum suction to control the spread of nonnative bivalves and gastropods as designated by the Idaho State Department of Agriculture in areas identified with infestations.

DEQ has certified Regional General Permit–Emergency (RGP-E) authorizing the temporary discharge of dredged or fill material to restore, repair, and/or stabilize features that have been damaged, destroyed, or are in imminent danger of failing during emergency conditions, defined as conditions that would result in an unacceptable threat to human life, significant loss of property, and/or significant economic hardship.
