    The Corps of Engineers, Regulatory program, regulates work and structures that are located in, under or over navigable waters of the United States under Section 10 of the Rivers and Harbors Act of 1899, the discharge of dredged or fill material into waters of the United States under Section 404 of the Clean Water Act, and the transportation of dredged material for the purpose of disposal in the ocean (regulated by the Corps under Section 103 of the Marine Protection, Research and Sanctuaries Act). "Waters of the United States" are navigable waters, tributaries to navigable waters, wetlands adjacent to those waters, and/or isolated wetlands that have a demonstrated interstate commerce connection.

    Individual Permits are two types of permits that the Corps can issue under program authorities. Individual permits include Standard Permits, which are generally more complex in nature and involve notification of the public and commenting agencies, and Letters of Permission, a type of permit issued through an abbreviated processing procedure which includes coordination with Federal and State fish and wildlife agencies, as required by the Fish and Wildlife Coordination Act, and a public interest evaluation, but without the publishing of an individual public notice. In compliance with our regulations at 33 CFR 325.2(a)(8), we are posting a list of issued individual permits. Pending individual permit applications, which have been determined to be "federally complete", are also posted to increase Regulatory Program transparency.

    Section 214 of the Water Resources Development Act (WRDA) of 2000, as amended (33 U.S.C. 2352) and Title 23 of the U.S. Code, Section 139(j) (Transportation Agreements) provide the authority to accept and expend funds from certain entities to expedite the review of permit applications. Deepwater Horizon Settlements are projects funded through the Deepwater Horizon oil spill restoration efforts. Examples of the funding sources include: Resources and Ecosystem Sustainability, Tourism Opportunities and Revived Economy of the Gulf Coast Act of 2012 (RESTORE), the National Fish and Wildlife Foundation (NFWF), and Natural Resources Damage Assessment (NRDA). Pending applications, final permit decisions, jurisdictional determinations and pre-application meetings for these projects will be displayed.

    The following tabs provide some additional information on Final Individual Permit decisions (Final IP tab), Pending Individual Permit applications under review (Pending IP tab) and Emergency Permits (Emergency tab) issued under the Alternative Permit procedures (33 CFR 325 (e)(4)), WRDA and Deep Horizon Settlements. Each of these tabs contains a Map icon, which when clicked, shows the location of the selected project on a map and includes some basic project information.

    These tabs will be expanded in the future to include additional project details, such as administrative appeals.

    In August 2015 a new tab was added to track Final Approved Jurisdictional Determinations (AJD). All final approved AJDs will be posted on this page. Information providing the Corps tracking number, project name, overall project location, and the final AJD form will be provided. Links to the AJD form posted on district websites will be visible until the expiration date of the AJD.

    Final AJDs, Final and Pending Individual Permit data, WRDA and DWH projects and Emergency Permit data are updated weekly.
