In the Application, Philips requested a stay of enforcement of the applicable provisions of DOE’s Energy Conservation Program: Energy Conservation Standards for Commercial and Industrial Electric Motors (Electric Motor Efficiency Standards), published on May 29, 2014, 79 Fed. Reg. 30934, and codified at 10 CFR Part 431.

EXC-16-0010 - In the Matter of Visual Sound LLC dba Truetone

This Decision and Order considers an Application for Exception from DOE Energy Conservation Standards for External Power Supplies filed by Visual Sound LLC dba Truetone. (Truetone), seeking exception relief from the applicable provisions of 10 C.F.R. Part 430, Energy Conservation Program: Energy Conservation Standards for External Power Supplies (EPS) (EPS Final Rule). In its request, Truetone asserts that it will suffer serious hardship, gross inequity, and an unfair distribution of burdens if it is required to comply with the EPS Final Rule, set forth at 10 C.F.R. § 430.32(w).

EXC-16-0004 - In the Matter of Eaton Corporation

On March 28, 2016, OHA denied an Application for Exception filed by Eaton Corporation (Eaton). In its Application, Eaton sought exception relief from the DOE’s distribution transformer efficiency standards, which became effective January 1, 2016.  Eaton, headquartered in Dublin, Ireland, is a manufacturer of electric power systems.  Due to malfunctions in its plants in late 2015, Eaton was unable to fully assemble, and certify with DOE, 28 distribution transformers before the new efficiency standards compliance date.

EXC-15-0001 - In the Matter of Reuland Electric Co.

On March 25, 2016, OHA issued a decision denying an Application for Exception filed by Reuland Electric Co. (Reuland).  In its Application, Reuland sought exception relief from the provisions of 10 CFR Part 431, Energy Conservation Program: Energy Conservation Standards for Commercial and Industrial Electric Blowers, 79 Fed. Reg. 30934 (2014) (Electric Motor Efficiency Standards), effective July 28, 2014 (codified at 10 C.F.R. § 431 .25).

On February 23, 2016, OHA granted an Application for Stay filed by Alcatel-Lucent USA (Alcatel).  Alcatel requested a stay of enforcement of DOE's February 2014 Energy Conservation Standards for External Power Supplies (Conservation Standards), with respect to a shipment of external power units imported by Alcatel that landed in the United States on February 11, 2016, one day after the compliance date of the Conservation Standards.
