COMMISSION MEETINGS AND HEARINGS

No Commission Executive Sessions or Open Meetings were scheduled this week.

ADVISORY OPINIONS

Advisory Opinions Considered

AOR 2012-20 (Mullin).On May 30, the Commission considered and voted on two draft advisory opinions but did not reach consensus on either draft based on a request from Markwayne Mullin. Mullin is a candidate for Congress from Oklahoma, and also the President and CEO of Mullin Plumbing, Inc. and Mullin Plumbing West Division, Inc. (the companies). Mullin asked whether the companies' proposed radio and television advertisements, in which he appears, are electioneering communications if aired in a pre-election time period. Mullin also asked whether, when he files disclosure reports for the companies' electioneering communications, he would be required to disclose the names and addresses of customers who paid $1,000 or more for the companies' services. A Statement was issued by Vice Chair Ellen L. Weintraub and Commissioner Cynthia L. Bauerly.

Drafts

AO 2012-18 (National Right to Life Committee, Inc.). On May 31, the Commission made public a draft of Advisory Opinion 2012-18. The requestor asks whether its payments for the establishment, administration, and solicitation costs of its independent expenditure-only political committee, National Right to Life Victory Fund, must be reported as contributions. Public comments on the draft are due by noon on June 6.

AO 2012-19 (American Future Fund). On May 31, the Commission made public two drafts of Advisory Opinion 2012-19. American Future Fund is a 501(c)(4) organization that intends to produce and distribute certain broadcast advertisements. It asks whether any of its proposed advertisements constitute electioneering communications. Public comments on the drafts are due by noon on June 6.

LITIGATION

Herron for Congress v. FEC (No. 11-cv-01466 (RC)). On May 25, the plaintiff filed the Plaintiff’s Combined Memorandum in Opposition to Commission’s Cross-Motion for Summary Judgment and Its Reply in Support of Its Motion for Summary Judgment in the United States District Court for the District of Columbia.

On May 31, the Commission posted a non-exhaustive list of adequate purposes for campaign finance expenditures on the Reports Analysis Division web page.  The list can be found here.
