Enforcement

The Department of Energy’s (DOE) Office of Enforcement promotes overall improvement in the Department's safety and security programs through management and implementation of the DOE enforcement programs for safety and classified information security that are authorized by the Atomic Energy Act. The office is independent of the DOE offices that develop and implement policy and programs.  The office conducts enforcement investigations using systematic enforcement practices to thoroughly evaluate operational events and conditions that represent potentially serious violations of the Department’s nuclear safety, worker safety and health, and classified information security regulations. These investigations can result in civil penalties against DOE contractors that violate the regulations.

Enforcement Process Overview, the Enforcement Coordinator Handbook and enforceable regulations and directives for worker safety and health, nuclear safety and security safety (linked below) are provided here.

Worker Health and Safety Enforcement

The Office of Worker Safety and Health Enforcement implements the Department’s worker safety and health enforcement program in accordance with 10 CFR 851 as authorized by the Atomic Energy Act.

Nuclear Safety Enforcement

The Office of Nuclear Safety Enforcement implements the Department’s nuclear safety enforcement program in accordance with 10 CFR 820 as authorized by the Atomic Energy Act.

Security Enforcement

The Office of Security Enforcement implements the Department's classified information security enforcement program in accordance with 10 CFR 824 as authorized by the Atomic Energy Act.

Noncompliance Tracking System (NTS)

The NTS is a database for DOE contractors to voluntarily report noncompliances with DOE nuclear safety and worker safety and health regulatory requirements, and to identify actions to correct the conditions and prevent recurrence. Contact: Lisa German

The enforcement program uses a variety of mechanisms, which are reflected in the Enforcement InfoCenter, to communicate with DOE contractors about regulatory and compliance issues. These mechanisms include Notices of Violation, Consent Orders, Settlement Agreements, and other Enforcement related information.
