Victim / Witness Assistance
How to Exercise the Rights Granted to You as a Victim and/or Witness
In order for a victim, or designated family member, to be eligible to receive notices and exercise the
rights provided by law, the victim or designated family member must complete a form promulgated by the
Louisiana Commission on Law Enforcement. The
Louisiana Victim Notice & Registration Form
shall be completed
by the victim or designated family member and shall be filed with the law enforcement agency investigating
the offense of which the person is a victim of a crime defined as: Homicide, 1st Degree Murder, Manslaughter,
Negligent Homicide, Vehicular Homicide, Vehicular Negligent Injuring, 1st Degree Vehicular Negligent
Injuring, any Sexual Offense or other felony offense defined in L.R.S. 14:2(13).
Confidentiality of Information
The completed Louisiana Victim Notice & Registration form shall be included in the documents sent by
the law enforcement agency to the district attorney for prosecution. The district attorney will file
the appropriate documents with the clerk of court's office. Upon conviction, the victim's notice and
registration form shall be included in the documents sent by the clerk of court to the Department of
Public Safety & Corrections, the law enforcement agency having custody of the defendant, or the division
of probation and parole. All victim notice and registration forms, and the included information, shall
be kept confidential by all law enforcement agencies having possession. The information shall not be
released unless only upon a court order after a contradictory hearing.
** The names, addresses, or identities of crime victims who are minors will not be publicly disclosed. "Minors" are
defined as those persons "who are minors at the time of the commission of the offense are under eighteen
years of age." Additionally, the names, addresses, or identities of sex crime victims will not be publicly
disclosed. "Sex Crimes" are defined as attempted or committed; Aggravated Rape, Forcible Rape, Simple
Rape, Sexual Battery, Aggravated Sexual Battery, Oral Sexual Battery, Aggravated Oral Sexual Battery,
Intentional Exposure to the AIDS virus, Stalking, Incest, Aggravated Incest, Carnal Knowledge of a Juvenile,
Indecent Behavior with Juveniles, Pornography involving Juveniles, Molestation of a Juvenile, Crime Against
Nature, Aggravated Crime Against Nature, Sexual Battery of the Infirm, and Video Voyeurism. **
