Motion of Robert G. Burnley, Director the Commonwealth of Virginia Department of Environmental Quality to Deny the District of Columbia Public Service Commission's Petition Further Analysis of Environmental Impacts of Requested Relief

Docket No. EO-05-01: Motion of Robert G. Burnley, Director the Commonwealth of Virginia Department of Environmental Quality to Deny the District of Columbia Public Service Commission's Petition on the Grounds that the Commission May Not Lawfully Grant the Requested Relief; or, in the Alternative, to Defer Action Pending Further Analysis of Environmental Impacts of Requested Relief.
Pursuant to Rules 203 and 212 of the Federal Energy Regulatory Commission's ("Commission") Rules of Practice and Procedure, 18 C.F.R. §§ 385.203 and 385.212, Robert G. Burnley, Director of the Commonwealth of Virginia's Department of Environmental Quality (the "Director'') hereby files this Motion in response to the Emergency Petition And Complaint ("Petition") filed by the Public Service Commission of the District of Columbia ("DC PSC" or "PSC") in the above-referenced proceeding before the Commission.
