Use of XRF's Containing Radioactive Material

Radioactive material is regulated by the North Dakota Department of Health.  A license is required in order to manufacture, produce, transfer, receive, acquire, own, possess, store, or use radioactive material in North Dakota.  These regulations also apply to portable gauging devices such as x-ray fluorescence (XRF) devices commonly used for lead-in-paint analysis.

XRF devices must never be "loaned out" to interested parties.  XRF devices may only be used by:

  • Employees who have attended the device manufacturer's training course (or any other training course approved by the Radiation Control Program) for gauge users,
  • Employees who have been instructed in the licensee's operating and emergency procedures, and
  • Employees who have been designated in writing by the licensee's Radiation Safety Officer
