Title IX

Title IX of the Education Amendments of 1972, as amended, prohibits discrimination on the basis of sex in all educational programs and activities of institutions that receive federal financial assistance. The law states, in part, that:

No person in the United States shall, on the basis of sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any education program or activity receiving federal financial assistance.

The Office of Civil Rights is responsible for monitoring and enforcing compliance with Title IX, investigating Title IX-related complaints, and providing technical assistance related to Title IX to recipients of Department of Energy financial assistance.

Department of Energy Title IX Implementing Regulations:
The Department has promulgated regulations implementing Title IX. The Department’s Title IX implementing regulations can be found at 10 C.F.R. Parts 1042 and 1040.

Filing a Complaint of Sex Discrimination:
If you believe that you have been discriminated against on the basis of sex by a recipient of federal financial assistance, you may file a complaint with the:

Your complaint should contain the following information: your name, address, and telephone number; the name and address of the agency, institution, or department you believe discriminated against you; how, why, and when you believe you were discriminated against, including as much information as possible about the alleged acts of discrimination, and the names of the individuals whom you allege discriminated against you, if known; and the names of any persons, if known, that the investigating agency could contact for additional information to support or clarify your allegations.

Title IX Post-Award Compliance Reviews:
Pursuant to the Department’s Title IX implementing regulations, 10 C.F.R. § 1040.101, and the America COMPETES Act, Pub. L. No. 110-69, § 5010, 121 Stat. 572, 620 (2007), the Office of Civil Rights conducts annual Title IX compliance reviews of selected recipients of DOE financial assistance.
