Depot Maintenance and Public-Private Partnering (PPP) Statutes

There are a range of Statutory Requirements that specify how, and by whom, DoD logistics activities are accomplished.  The majority of these are in Title 10 of the US Code (10 USC).  The various sections of Title 10 specify requirements that range from how much Depot workload may be performed by contractors, to what Depot workload is so essential that DoD must ensure that it maintains a "core" capability in those areas, to how Depot public/private partnerships may be implemented.

The following are pertinent statutory sections of US Code, the actual text can be found by accessing the US Code website listed below in "related websites" and searching for the appropriate sections.

2208. Working-capital funds.

2208j. Direct sales of items.

2460. Definition of depot-level maintenance and repair.

2461. Commercial or industrial type functions: required studies and reports before conversion to contractor performance.

2461a. Development of system for monitoring cost savings resulting from workforce reductions.

2462. Contracting for certain supplies and services required when cost is lower.

2463. Collection and retention of cost information data on converted services and functions.

2464. Core logistics capabilities.

2465. Prohibition on contracts for performance of firefighting or security-guard functions.

2466. Limitations on the performance of depot-level maintenance of materiel.

2467. Cost comparisons: inclusion of retirement costs; consultation with employees; waiver of comparison.

2469. Contracts to perform workloads previously performed by depot-level activities of the Department of Defense: requirement of competition.

2470. Depot-level activities of the Department of Defense: authority to compete for maintenance and repair workloads of other Federal agencies. 

2472. Management of depot employees.

2473. Procurements from the small arms production industrial base.

2474. Centers of Industrial and Technical Excellence: designation; public-private partnerships.

2475. Consolidation, restructuring, or re-engineering of organizations, functions, or activities: notification requirements.

2563. Articles and services of industrial facilities: sale to persons outside the Department of Defense.
