AB177 Effective July 1, 2009 – Allows a lessor to increase the dollar amount of a lessee’s responsibility for physical damage to a vehicle resulting from vandalism, from $500 to $2,500. Allows a lessor to add damage or loss from theft by an authorized driver or a person aided or abetted by an authorized driver, to the circumstances where a waiver of damages does not apply.
AB333 Effective July 1, 2009 – Requires tow companies to notify owners of towed vehicles of the rebuttable presumption of ownership and how to rebut. Also creates a DMV site for electronic notification by selling parties of their transfer of ownership in a vehicle.
AB414 Effective July 1, 2009 – Increases light duty diesel gross vehicle weight for annual emission testing requirements from 10,000 to 14,000 pounds. Changes the definition of tri-mobile to match the Code of Federal Regulations for weight compliance for the purposes of OBD II testing requirements. Requires reconstructed vehicles to be emission tested to the year of the engine.
AB482 Effective July 1, 2009 – Transfers the regulation of garages and body shops from Consumer Affairs to the Department of Motor Vehicles.
AB561 Effective July 1, 2009 – Same as above.
SB234 Effective July 1, 2009 – Changes in fees and tax structures for short term vehicle lessors. Specifics are being sent by Department of Taxation.
SB360 Effective January 1, 2010 – Authorizes a person other than an automobile wrecker, dealer or rebuilder, to purchase a vehicle, other than a non-repairable vehicle, from a Salvage Pool. The person may not purchase more than three vehicles in any calendar year and may not purchase any vehicle for resale. Before bidding on a vehicle, the person must obtain an identification card from the Department. Extends the time frame from 60 to 180 days, for insurance companies/representatives to obtain title from an insurance settlement.
SB394 Requires titling and registration of off highway vehicles. Requires dealers of these vehicle types to be licensed with the Department of Motor Vehicles. Implementation of this law is contingent upon receiving initial start up funding.
SB395 Effective January 1, 2010 – Requires dealers beginning in 2012, to post carbon emissions data on all new vehicles displayed for sale if such information exists.
