FTA Issues Record of Decision for Warm Springs Extension Project

The Record of Decision (ROD) for the San Francisco Bay Area Rapid Transit District (BART) Warm Springs Extension Project is now available. The Federal Transit Administration (FTA) has determined that the requirements of the National Environmental Policy Act (NEPA) have been satisfied for the Warm Springs Extension Project. The ROD represents the basis for the FTA's decision.

The project and alternatives were evaluated in the Final Environmental Impact Statement (FEIS) and 4(f)/6(f) Evaluation issued by BART and the FTA in June 2006. The FEIS examines the benefits and the potential environmental impacts of the preferred alternative, the 5.4-mile extension of the BART line to the Warm Springs district of Fremont, with an optional station at Irvington. Areas of potential impacts include: transportation; geology and soils; hazards and hazardous materials; hydrology; wetlands; biological resources; land use; parks and recreation; population, economics and housing; aesthetics; cultural resources; noise and vibration; air quality; energy; utilities and public services; safety and security. A summary of the mitigation measures for potentially significant impacts is attached to the ROD. The ROD concludes that all reasonable steps have been taken to minimize adverse environmental effects.

BART Releases Final Environmental Impact Statement for Warm Springs Extension Project

The Federal Transit Administration (FTA), as federal lead agency, and BART have released the Final Environmental Impact Statement (FEIS) for the Warm Springs Extension. The FEIS was undertaken to qualify the Warm Springs Extension project for federal funding. To become eligible for such funds, the project must complete an environmental review under the National Environmental Policy Act (NEPA). The FTA and BART considered and incorporated the results of previous studies into the FEIS, including the 1992 BART Warm Springs Extension Environmental Impact Report (EIR) and the 2003 Supplemental EIR. In addition, the EIS complies with other environmental requirements that apply only to federal actions and not to the CEQA analysis previously conducted. These requirements include:

  • Executive Orders on Environmental Stewardship, Transportation Infrastructure, Environmental Justice, Floodplain Management, and Protection of Wetlands
  • Federal Department of Transportation Act (Section 4(f))
  • Federal Land and Water Conservation Fund (Section 6(f))
  • National Historic Preservation Act (Section 106)

The FEIS is available at the Fremont Main Library and the MTC/ABAG library. It is also available for public review at the BART Transit System Development Office, 300 Lakeside Drive, 21st Floor, Oakland, CA 94612. Environmental issues analyzed in the EIS include, but are not limited to: transportation and traffic impacts; the use of parkland, including Fremont Central Park; biological resources and sensitive species; land use, including consistency of proposed stations with local plans and policies; potential impacts to historic and cultural resources; noise and vibration impacts on homes and other sensitive receptors near the tracks.
