FHWA BASIC CIVIL RIGHTS PROGRAM TRAINING
A basic overview of the major FHWA civil rights programs and authorities, as well as how to administer the programs at the Division Office and the State DOT levels, including development, monitoring, implementation, and approval of State program documents. The course is divided into six separate modules for the following program areas: State DOT Internal EEO/Affirmative Action, EEO Contractor Compliance, Investigation of Discrimination Complaints, Title VI/Environmental Justice, Disadvantaged Business Enterprise, and Americans with Disabilities Act.
TARGET AUDIENCE:
All FHWA, State DOT, and other recipient personnel assigned civil rights responsibilities on either a full or part-time basis. In addition, FHWA division administrators, assistant division administrators, Team Managers and State DOT management personnel in any discipline with significant civil rights implications (e.g. planning, contract administration, legal, environment, safety, right-of-way and relocation, and research. A minimum of 15, not to exceed 30, participants is required to hold a session.

AMERICANS WITH DISABILITIES ACT (ADA)/504
Course length: 1 hour - 2 days, depending on need. Can be in-person, web-conference, video-conference, tele-conference
This course provides attendees with an understanding of the authorities, regulations, and coverage of the program; an overview of the FHWA's ADA compliance program; and clarifies ADA compliance standards. Participants, whether recipients or public entities, will know the recipients and public entities' responsibilities under the ADA and related statutes.

Conducting DBE Certification On-Site Reviews Training Course
Course length: 1 day
Target audience: State DOT Certification staff, and UCP staff involved in making certification decisions.
At the end of this training participants will be able to:
- Explain the DBE Program Certification Objectives and Requirements
- Identify the DBE Certification Eligibility Requirements for DBE Certification
- Explain How to Review and Analyze an Application for Scheduling an On-site Review
- Explain How to Prepare for a DBE On-site Certification Review
- Demonstrate How to Conduct a DBE On-site Certification Review
- Identify Key Elements to Support DBE Certification Decisions
DESIGNING PEDESTRIAN FACILITIES FOR ACCESSIBILITY (DPFA)
Course length: 1 – 2 days
This course, developed by the Federal Highway Administration (FHWA) and the Association of Pedestrian and Bicycle Professionals (APBP), provides an overview of the Americans with Disabilities Act (ADA) and teaches participants how to apply guidelines and policies to the public rights-of-way. The following areas are covered:
- Background about the Americans with Disabilities Act (ADA); Section 504 and other applicable laws
- Characteristics of pedestrians and the pedestrian environment
- Legal requirements; U.S. DOT and FHWA policies and funding opportunities
- Accessible design elements of the pedestrian corridor
- Accessible driveways and curb ramps
- Street crossings, including crosswalks, overpasses, underpasses, medians and islands
- Intersections, including roundabouts
- Pedestrian signs and signals, including accessible pedestrian signals (APS)
- Temporary facilities and construction site safety

DBE PROGRAM OVERVIEW
Course length: 1 day
At the end of this training, participants will be able to:
- Recognize the background and history of the DBE program
- Identify the major components of the DBE program requirements in 49 CFR 26
- Describe eligibility standards and procedures to ensure consistency in making certification decisions under a Unified Certification Program (UCP)
- Utilize U.S. DOTs questions and answers as guidance to interpret 49 CFR 26
DBE CERTIFICATION
Course length: 1 – 2 days
At the end of this training, participants will be able to:
- Describe major DBE program requirements of 49 CFR 26
- Describe eligibility standards under 49 CFR 26 -- Subpart D and procedures under Subpart E
- Apply certification standards and procedures to ensure consistency in making certification decisions under a Unified Certification Program (UCP)
- Use USDOT questions and answers as guidance to interpret 49 CFR 26 Subpart D and E
DBE CONTRACT ADMINISTRATION
Course length: 1 day
At the end of this training, participants will be able to:
- Recognize the background and history of the DBE program
- Identify the major components of the DBE program requirements in 49 CFR 26
- Define concepts of DBE goals, race neutral/race conscious, good faith efforts, counting, and commercially useful function (CUF)
- Explain the responsibilities of DOT recipients to monitor DBE program participants
- Identify project level monitoring responsibilities to ensure DBE program objectives are achieved
CONTRACTOR COMPLIANCE
Course length: 4 hours – 1 day
This course focuses on the Equal Employment Opportunity program objectives and authorities, and how to apply appropriate authorities in making EO compliance determinations. This course also highlights the key roles and responsibilities of FHWA, State transportation agencies, and contractors to ensure EO in Federal-aid highway construction projects.
EQUAL OPPORTUNITY CONTRACTOR COMPLIANCE REVIEWS
This course focuses on the Equal Opportunity Contractor Compliance Program objectives, background and how to apply appropriate authorities in making EO compliance determinations. A detailed overview of the contract compliance review process is also covered. This course also highlights the key roles and responsibilities of FHWA, State transportation agencies, and contractors to ensure EO in Federal-aid highway construction projects.
INVESTIGATING EXTERNAL COMPLAINTS OF DISCRIMINATION
Course length: 4 hours – 2 days
This course will cover the authorities and six theories of discrimination, the elements of a prima facie case, and the steps for conducting an investigation of a discrimination complaint.
PREVENTING DISCRIMINATION IN THE FEDERAL-AID HIGHWAY PROGRAM
Course length: 8 hours – 2 days
This course targets how to apply Title VI, as well as how to integrate law and regulation implementation in each Federal-aid highway project from an interdisciplinary approach. The course provides an understanding of Title VI and other related non-discriminatory authorities; defines the roles and responsibilities for implementing the Title VI program; and explains the systematic, interdisciplinary approach.
STATE INTERNAL EEO
Course Length: 4 hours
The main emphasis of this course is to provide an understanding of State Internal EEO/Affirmative Action Program authorities; to identify requirements and contents of these plans; to define the roles and responsibilities for program review/approval; and to review and identify methods of obtaining compliance and enforcement actions.
