Extension Of State Declaration Notice 49 CFR § 390.25

Pursuant to Title 49 CFR § 390.25, I, William R. Paden, Regional Field Administrator of the Federal Motor Carrier Safety Administration, declare an emergency exists that warrants extension of the State Emergency Declarations continuing the exemption granted in accordance with 49 CFR § 390.23 from Part 390 through 399 of the Federal Regulations (Federal Motor Carrier Safety Regulations), except as otherwise restricted by this declaration. The emergency declarations were in response to the shortage of motor fuels, particularly diesel fuel and its components such as ethanol and biodiesel, due to inadequate supplies at terminals and increased demand, resulting in an immediate threat to the distribution chain that supplies essential diesel fuel to farmers, ranchers, and other industry supporting the public welfare within the State of North Dakota.

This emergency exemption is issued as a result of the Governor’s Declarations of Emergency regarding the need to allow drivers and carriers transporting motor fuels to obtain such fuel from greater distances to supply the people of North Dakota.
