The Department of Transportation is announcing an initiative to permit, on an experimental basis, Federal Highway Administration (FHWA) and Federal Transit Administration (FTA) recipients and subrecipients to utilize various contracting requirements that generally have been disallowed due to concerns about adverse impacts on competition.

MAP-21 Section 1305 requires FHWA and FTA to initiate a rulemaking to allow for the use of programmatic approaches that are consistent with the National Environmental Policy Act (NEPA) and other applicable laws to conduct environmental reviews. FHWA and FTA are conducting outreach to these stakeholders through a national online dialogue and targeted listening sessions. Following completion of the outreach process, the Agencies will initiate a Notice of Proposed Rulemaking that provides interested parties with the opportunity to comment on proposed new and/or modified Agency regulations.

In January 2011, President Obama outlined a plan to create a 21st-century regulatory system – one that protects public health and welfare while promoting economic growth, innovation, competitiveness, and job creation. Part of that plan was an unprecedented government-wide review of regulations already on the books. During my confirmation hearings, I pledged to accept the President's challenge and to make improving efficiency one of my top priorities.
And with today’s announcement from the Federal Motor Carrier Safety Administration, we are delivering on that pledge.
Today, we are proposing a rule that will dramatically eliminate a major burden and save trucking companies about $1.7 billion each year.
