Respondent was assessed a civil penalty of $17,700 for three violations of the HMR when it filled DOT specification compressed gas cylinders with carbon dioxide, a non-flammable gas hazardous material, and offered the filled cylinders for transportation in commerce when the cylinders had not been reinspected and retested within the past five years (violation No. 1); Respondent allowed its employee to perform a function subject to requirements in the HMR when the employee had not received hazmat employee training (violation No. 2); and the cylinders were not accompanied by a shipping paper properly describing the material as hazardous and containing an emergency response telephone number, and the cylinders were not marked and labeled (violation No. 3).
