DIVISION OF FLORIDA HIGHWAY PATROL COMMERCIAL VEHICLE ENFORCEMENT

SUBJECT:    Executive Order 16-205 Tropical Depression #9

The Governor of Florida has issued Executive Order Number 16-205 for Tropical Depression #9, which is expected to intensify into a tropical storm in the immediate future. The Executive Order declares a state of emergency for the following counties:  Alachua, Baker, Bay, Bradford, Brevard, Calhoun, Citrus, Clay, Columbia, Dixie, Duval, Flagler, Franklin, Gadsden, Gilchrist, Gulf, Hamilton, Hernando, Hillsborough, Jackson, Jefferson, Lafayette, Lake, Leon, Levy, Liberty, Madison, Marion, Nassau, Orange, Pasco, Pinellas, Polk, Putnam, Seminole, St. Johns, Sumter, Suwannee, Taylor, Union, Volusia, and Wakulla.

Pursuant to the Executive Order, the Department will be suspending/waiving enforcement of the following for vehicles that are transporting emergency equipment, emergency supplies, or emergency personnel:

•    Registration requirements pursuant to sections 316.545(4) and 320.0715, Florida Statutes.
•    Hours of Service requirements.
•    Licensing and registration requirements under the International Fuel Tax Agreement pursuant to Chapter 207, Florida Statutes, and the International Registration Plan pursuant to section 320.0715, Florida Statutes, when such vehicles are properly registered in other jurisdictions.

Pursuant to 49 CFR 390.23, commercial motor vehicles operating to provide emergency relief during this declaration will be relieved from complying with the regulations identified in 49 CFR Parts 390-399.

Pursuant to this Executive Order, the Florida Department of Transportation has the authority to issue special permits that allow for increased size and weight restrictions for divisible loads on any vehicles transporting emergency equipment, services, supplies, and may issue permits for agricultural commodities and citrus that may be affected by the emergency. Such permits have not been issued by the Florida Department of Transportation at this time, but are anticipated. These permits and related documentation will be forwarded to you as soon as they are made available.

CVE Troop Commanders and CVE District Commanders have been directed to coordinate with Patrol Operations commanders to utilize personnel and resources effectively in responding to deteriorating weather conditions. This will be a team effort to ensure the safety and security of Florida's citizens.

Be certain to take precautionary measures to ensure the safety of your family and property, maintain communication with your supervisors, and ensure your uniforms and equipment are in a state of readiness for response.
