Respondent was assessed a civil penalty of $13,890 for three violations of the HMR when it offered for transportation in commerce acetone, a flammable liquid hazardous material, which was not described as required on a shipping paper and the outer packaging was not marked with the proper shipping name and UN identification number for this material or labeled with the required hazard warning label (violation No. 1); in a packaging which was not authorized for this material because it was not marked as meeting a UN performance standard in the HMR (violation No. 2); and when its employees who performed functions subject to the HMR had not received recurrent hazmat employee training (violation No. 3).
