Respondent was assessed a civil penalty of $5,394 for three violations of the HMR when it ( 1) filled, offered for transportation, and transported DOT exemption/special permit cylinders that were out of test and requiredrequalification, (2) listed an emergencyresponse telephone number for an organization that had not accepted responsibility for providing detailedinformation concerning the hazardous material, and (3) failed to register with PHMSA when it transported a hazardous materialthat required placarding.
