Respondent was assessed a civil penalty of $10,352 for seven violations of the HMR when it (1) failed to perform a hot water bath test on filled aerosol containers offered for transportation in commerce; (2) offered a hazardous material for transportation in commerce in outer packagings that were not marked with the proper shipping name and had incorrect orientation arrow markings; (3) offered a hazardous material for transportation in commerce in a quantity requiring the transport vehicle to display a placard, when Respondent had not registered as a person offering hazardous materials with the U.S. DOT; (4) failed to provide its hazardous materials employees with required hazardous materials training; (5) prepared shipping papers that accompanied hazardous materials while in transportation when the shipping papers contained additional information interspersed in the description and did not contain the number and type of packaging; (6) offered for transportation in commerce and transported in commerce a hazardous material when Respondent failed to retain shipping papers; and (7) offered a hazardous material for transportation in commerce when the hazardous material was contained in a packaging that had not been closed in accordance with the manufacturerÂ’s closure instructions.  One alleged violation reduced to a warning.  Parts of two other alleged violations dismissed.
