The Chief Counsel found that Chemlogic, Inc., committed one violation of the HMR: offering for transportation in commerce a hazardous material, corrosive liquid, n.o.s. (containing sodium hydroxide) in a packaging certified as meeting a UN performance standard in the HMR, when the packaging had not been closed in accordance with the manufacturer’s closure instructions. The Order also withdrew one violation upon a determination that one of the shipments observed by the inspector qualified for the MOTs (Materials of Trade) exception, which excepts some shipments of hazmat from the regulations when the shipment is made by a private motor carrier in direct support of a principal business other than transportation by motor vehicle." The Order assessed a civil penalty of $1,750, after making reductions for financial hardship. The Order also authorized a payment plan.
