The Chief Counsel found that BPL Limited committed one violation of the HMR: Offering for transportation in the U.S. packagings, on which Respondent placed hazardous materials markings and labels, and when Respondent made a declaration in its shipping paper indicating the contents of the packagings to be a hazardous material when in fact the wooden crates did not contain a hazardous material. The Order discusses a prior appeal in which the company successfully argued it had not received due process in the form of an informal hearing. The Order also discusses the relationship between the HMR, ICAO Technical Instructions and IATA regulations. The Order assesses a civil penalty of $500.
