Respondent was assessed a civil penalty of $19,200 for two violations of the HMR, by offering for transportation in commerce cylinders containing compressed gas, oxidizing, n.o.s. (90% oxygen, 10% nitrogen), in outer packagings that were not marked with the proper shipping name and identification number for this material and did not have the required hazard warning labels, and without providing a shipping paper describing the material as hazardous (violation No. 1), and allowing employees to perform functions subject to requirements in the HMR when the employees had not received hazmat employee training and training records had not been created and retained (violation No. 2).
