The Chief Counsel assessed a civil penalty of $19,200 for two violations of the HMR, including offering a hazardous material (Compressed gas, oxidizing, n.o.s. (90% oxygen, 10% nitrogen), 2.2 (5.1), UN3156) for transportation in commerce: (1) while failing to declare the material as hazardous and failing to provide shipping papers, and failing to mark and label the package(s) as containing hazardous materials; and (2) while failing to provide general awareness, function-specific and security awareness training and failing to document safety training.  The Order describes the prompt action by Respondent to correct the undeclared hazardous materials shipment problems and to provide training for its employees.
