Respondent was assessed a civil penalty of $6,255 for three violations of the HMR, when it filled DOT Specification compressed gas cylinders with Division 2.2 (nonflammable) gases when the cylinders were overdue for requalification and offered the filled cylinders for transportation in commerce (violation No. 1); it allowed hazmat employees to perform functions subject to the HMR when the employees had not received hazmat employee training (violation No. 2); and it represented, marked, and certified DOT Specification compressed gas cylinders as having been successfully requalified for continued service in accordance with the HMR when it failed to maintain complete and accurate records of calibration and cylinder requalification (violation No. 3).
