The Chief Counsel assessed a civil penalty in the amount of $7,284.00 for five violations of the HMR. (1) No visual inspectionwas performed on cylinders which were subjected to physical abuse and transported with no authority which was a violation of 49 C.F.R. §§ 171.2(a), 173.301(a)(2), 173.301(e), and 180.205(d)(1) & (3). (2) No emergency contact number was posted on Bill of Lading which is in violation of 49 C.F.R. §§ 171.2(a), 172.201(d), and 172.604(a)-(b). (3) At the time of shipment placarded quantites of Hazardous Material were not registered with DOT which was in violation of 49 C.F.R. §§ 171.2(a), 107.601(a)(6), and 107.608(a)-(b). (4) No training for Safety, HMR familiarization or general awareness was provided to hazmat employees to perform functions in the HMR which was in violation of 49 C.F.R. §§ 171.2(a), 172.702(a) and 172.704(a). (5) No shipping papers were retained by the respondent for prior shipments within the 375 day HMR requirement which was in violation of 49 C.F.R. § 171.2(a) and 172.201(e).
