Respondent was assessed a civil penalty of $11,300 for two violations of the HMR when it offered paint, a flammable liquid hazardous material, for transportation in commerce in packagings to which hazard class warning labels were not affixed and which were not accompanied by a shipping paper containing the required description of this material as hazardous and which did not contain an emergency response telephone number (violation No. 1), and it allowed an employee to perform a function subject to the requirements of the HMR when the employee had not received hazmat employee training and training records had not been created and retained (violation No. 2).
