Respondent was assessed a civil penalty of $8,000 for one violation of the HMR when it offered for transportation in commerce Division 1.3G fireworks, explosive hazardous materials, which had not been approved and assigned a shipping classification by PHMSA's Associate Administrator for Hazardous Materials Safety.
