Summary

On November 23, 2015, the Federal Motor Carrier Safety Administration (FMCSA) debarred Mounir R. Khouri for 3 years. Khouri was previously suspended based on his conviction related to a scheme to defraud transportation companies employing commercial drivers subject to random drug testing. In July 2012, Khouri was sentenced in U.S. District Court, Brattleboro, Vermont, to 1 month of incarceration, 2 years supervised release, and $22,513 in restitution.

Khouri did business as Mobile Testing Services, Inc., an FMCSA regulated third party administrator. He represented himself as capable of assisting transportation companies to comply with USDOT regulations, which require that trained collectors obtain urine samples for drug testing and ship them to licensed labs with a completed Control and Custody Form (CCF). A Medical Review Officer (MRO), who is a licensed physician trained in substance abuse, must then review the test results. However, in 2009, Khouri subverted the role of the MRO by falsifying the CCFs and giving test results which were not reviewed by an MRO. After Khouri's contracted drug testing lab stopped testing due to nonpayment, he prepared false CCFs for untested specimens, misrepresenting that the specimens tested negative and billing his clients for services not provided.
