Summary

A Federal grand jury in Philadelphia, PA, returned indictments against eight truck drivers, Ontelaunee Transport Services, Inc. of Kempton, PA, and its dispatcher on charges of violating criminal laws relating to Federal regulations that limit the number of hours truckers can drive. The indictments allege the drivers falsified their logbooks, some for as long as three years.

One defendant, Stanley N. Waddy, Jr., a driver for Tapscott Trucking in Thornburg, VA, was also charged with causing a fatal accident after he had used marijuana. That crash occurred on December 12, 2001, when Waddy allegedly was driving a tractor-trailer and rear-ended another vehicle, resulting in a six-vehicle collision. One of the vehicles burst into flames, killing its driver and his wife. The other seven indicted drivers were employees of David Kistler and Grandson, Inc., or its successor company, Ontelaunee Transport Services. The now-defunct David Kistler and Grandson and several of its officials were fined a total of $50,000 in September 2001 for multiple violations of criminal laws relation to Federal hours-of-service regulations. OIG investigated the case with assistance from the Federal Motor Carrier Safety Administration.
