Statutory and Implementing Authority

Statutory Authority

The statutory authority for the Public Benefit Conveyance Program is the Federal Property and Administrative Services Act of 1949, as amended by the National Defense Authorization Act for Fiscal Year 1994 (Public Law 103-160, Section 2927). Disposal of property owned by an executive agency of the Government was initially accomplished by the Federal Property Management Regulations (FPMR); however the FPMR, has been superseded by the Federal Management Regulation (FMR). Section 102-75 of the FMR pertains to the disposal of surplus Federal real property and related personal property.

Implementing Authority

Authority for administering the Port Conveyance Program was granted to the Secretary of Transportation, which was delegated to the Maritime Administrator, pursuant to 49 CFR § 1.66(z), who delegated the responsibility to the Office of Deepwater Ports & Offshore Activities.

The Port Conveyance Program is regulated by 46 CFR § 340 and 46 CFR § 387.
