This was a commercial contract for the delivery of a total of ten FAA certified fixed training device flight simulators. The Air Force converted a termination for cause to a termination for convenience. ASBCA found the Air Force position in regard to the claim unreasonable.

The termination for convenience clause specifically provides that a contractor may recover, “reasonable charges the Contractor can demonstrate to the satisfaction of the Government using its standard record keeping system, have resulted from the termination.
