PAO — Freedom of Information Act (FOIA)

"A democracy works best when the people have all the information that the security of the nation permits. No one should be able to pull the curtains of secrecy around decisions which can be revealed without injury to the public interest."

– President Lyndon Johnson signing the Freedom Of Information Act into law.

The Freedom Of Information Act, passed in 1966 and amended in 1974, 1986, and 1996, was intended to create an environment in which:

  • Disclosure is the general rule, not the exception.
  • All individuals have equal rights of access.
  • The burden be on the government to justify the withholding of a document, not on the person who requests it.
  • Individuals denied access to documents have a right to seek injunctive relief in the courts.
  • Government policy and attitude reflect openness, not secrecy.
"It is the policy of the Department of Defense to make available to the public the maximum amount of information concerning its operations and activities..."

—Department of Defense Directive 5400.7
