2016-03-LRD - 6/22/2016: On November 16, 2015, the Ohio Environmental Protection Agency (Ohio EPA) advertised proposed modifications to the issued Clean Water Act section 401 water quality certification for the Department ofthe Army 2012 Nationwide Permits (NWPs) described in the February 21, 2012, Federal Register (77 FR 10184). The U.S. Army Corps of Engineers (Corps) Great Lakes and Ohio River Division, representing the Huntington, Louisville, Buffalo, and Pittsburgh Districts, is considering this request and providing an opportunity for the public to express their views on proposed changes to the Corps 2012 Regional General Conditions 4, 4(3), 5( e ), 5(±), 6(b ), 6( e) and 6(±) for the State of Ohio (see enclosure). These changes are under consideration in order to achieve consistency with the proposed Ohio EPA 401 water quality certification modifications.

LRH-2016-00006 - 6/14/2016: INITIAL PUBLIC NOTICE NATIONWIDE PERMIT REISSUANCE REQUEST FOR COMMENTS On June 1, 2016, the U.S. Army Corps of Engineers published in the Federal Register its proposal to reissue the 50 existing nationwide permits (NWPs) and issue two new NWPs. Nationwide permits are general permits issued on a nationwide basis to streamline the authorization of activities that result in no more than minimal individual and cumulative adverse environmental effects. Many of the proposed NWPs require notification to the district engineer before commencing those activities, to ensure that the activities authorized by those NWPs cause no more than minimal individual and cumulative adverse environmental effects.

This notice serves as the United States Army Corps of Engineers’ (Corps) request to the West Virginia Department of Environmental Protection (WVDEP) to act on Section 401 Water Quality Certification for the following application.

LRH-2012-147 Regional Permit - 5/13/2016: Summary: The District Engineer has re-issued a regional permit for stream restoration activities to be performed by the West Virginia Conservation Agency (WVCA) pursuant to Section 10 of the Rivers and Harbors Act of 1899 and Section 404 of the Clean Water Act. The purpose of this regional permit is to expedite Corps review of requests for authorizations for the WVCA to perform projects in waters under the jurisdiction of the Corps for the purposes of alleviating hazards to life and property.
