Joint Application for Permit

The Army Corps of Engineers (Corps), the Idaho Department of Water Resources (IDWR), and Idaho Department of Lands (IDL) has established a joint process for activities impacting jurisdictional waterways that require review and/or approval of both the Corps and the State of Idaho.

Department of Army permits are required by Section 10 of the Rivers & Harbors Act (1899) and Section 404 of the Clean Water Act.

State permits are required under the State of Idaho, Stream Protection Act, Title 42, Chapter 38, Idaho Code and the Lake Protection Act, Section 58, Chapter 13 et seq., Idaho Code. 

Drawings and Illustrations

There are three (3) specific types of drawings that are required to accurately depict work activities.  The vicinity map, the plan view drawing, and a cross or sectional view drawing (sometimes called an elevation drawing) must be included for the application packet to be considered complete. All drawings must be reproducible (black and white) and on 8-½” x 11” white paper.

Disclosure of information requested in the application is voluntary, however, if the information is not provided, the application may not be processed and permits may not be issued.

Do not start any work on any project until all permits from both the Corps and the State of Idaho have been received.

Application Packet

Per 33 CFR 325(3)(a), a complete application packet is required to properly process any application.

Applicant will need to send a completed application, along with one (1) set of legible and reproducible drawings illustrating the location and the character of the proposed activities/project to both the Corps and the State of Idaho.

Information provided on this application will be used in evaluating the proposed activities, which may include, but are not limited to construction, dredging, filling, excavation, etc. in waters or in wetlands.
