Nationwide Permits (NWP) are a type of general permit issued nationally by the U.S. Army Corps of Engineers (USACE). The NWPs are intended to regulate with little, if any, delay or paperwork certain activities having no more than minimal adverse environmental impacts under the USACE Regulatory Program authorities. There are currently 50 NWPs with 31 general conditions. The NWPs are valid for 5 years from the date of issuance. The current NWPs expire on March 18, 2017. Per regulation, the NWPs must be reissued every 5 years. The reissuance process involves full interagency and public review.
The USACE has published its proposal to reissue and modify the NWPs and solicit comments in the Federal Register, dated June 1, 2016. The comment period for the NWPs is 60 calendar days. Instructions on how and where to submit comments on the NWPs is available in the Federal Register notice. The USACE Albuquerque District has also issued proposed regional conditions for the proposed NWPs in the states of New Mexico and Colorado, as well as the Navajo Nation. The USACE Galveston District has issued proposed regional conditions in the State of Texas. The comment period for the proposed regional conditions is 45 calendar days from the date of issuance.
