The purpose of this Public Notice is to inform the general public that the Vicksburg District of the U.S. Army Corps of Engineers (USACE), along with the approval of the Federal Highway Administration (FHWA), has decided to accept and expend funds contributed by the Mississippi Department of Transportation (MDOT), a non-federal public agency, in accordance with section 214 of the Water Resources Development Act of 2000,as amended by section 1006 of the Water Resources Reform and Development Act of 2014, codified in 33 U.S.C. § 2352, provides that the Secretary of the  Army , after public notice, may accept and expend funds contributed by a non-Federal public entity to expedite evaluation of permit applications from that entity related to public projects or activities falling under Army regulatory jurisdiction.

Nationwide Reissuance Description:  On June 1, 2016, HQ-USACE published the proposed 2017 Nationwide Permits (NWPs), conditions, and definitions in the Federal Register (available at: www.regulations.gov, docket number COE-2015-0017). The Vicksburg District, as the lead district for the development of NWP regional conditions for the state of Mississippi, is seeking comments on the proposed 2017 NWP regional conditions for Mississippi.  Comments on the regional conditions should be submitted directly to the Vicksburg District by July 23, 2016 as described in this notice.  Similar public notices proposing regional conditions for Arkansas and Louisiana are being published concurrently by Little Rock District (http://www.swl.usace.army.mil/Missions/Regulatory/PublicNotices.aspx) and New Orleans District (http://www.mvn.usace.army.mil/Missions/Regulatory/PublicNotices.aspx), respectively.

Project Description: The Vicksburg District is posting a Public Notice to notify the public of the reissuance of Regional General Permit 34 (RGP-34) for the construction of minor structures to facilitate the loading and/or unloading of nonhazardous materials on barges, and the associated discharge of dredged and/or fill material, at specified sites along navigable waters of the United States within the regulatory jurisdiction of the Vicksburg District in the States of Arkansas, Louisiana, and Mississippi.  The General Permit will become effective on September 30, 2014, and will be valid for 5 years.  At the end of that time, the cumulative environmental effects of completed work will be reviewed and reissuance of the permit may be considered. However, if unforeseen adverse environmental effects result from the issuance of this General Permit, it may be modified or terminated at any time.

The U.S. Environmental Protection Agency (EPA) and the U.S. Department of the Army (Army) are announcing the withdrawal of an interpretive rule addressing the exemption from permitting provided under section 404(f)(1)(A) of the Clean Water Act (CWA).  The agencies want to make clear that the statutory exemption of 404(f)(1)(A) still remains available for use when applicable for discharges of dredged and/or fill material associated with normal farming, silviculture, and ranching activities that are part of an established operation and that do not have as their purpose bringing an area of waters of the U.S. into a use to which it was not previously subject, where the flow or circulation of the waters of the U.S. may be impaired or the reach of such waters be reduced (see 33 CFR 323.4 for more information).
