The Congress authorized the United States Army Corps of Engineers (USACE) to conduct a study of BIH, Texas to determine whether the project should be modified in any way, particularly with a view to widening and deepening the existing channels, pursuant to a resolution of the Committee on Public Works, United States House of Representatives dated May 5, 1966.
Additionally, in the Water Resources Development Act (WRDA) of 1986 (Public Law 99-662) dated November 17, 1986, Section 105 established cost share requirements. Additional legislation was passed in the Fiscal Year (FY) 2003 Omnibus Appropriations Bill, stating that any work performed by the BND as part of the restoration of wetlands in Bahia Grande will be used as credit towards the mitigation requirements of the BIH deepening project.
