"The decision whether to issue a permit is based on an evaluation of the probable impacts, including cumulative impacts, of the proposed activity and its intended use on the public interest" (33 CFR 320.4(a)).
In order to better evaluate the detriments and benefits of a project to the public, input is solicited from the public at large. The major tools used to interact with the public are the public notice, public hearing and input from other interested parties.
Public notices are issued within 15 days of receipt of all requested information to make an application complete.
Comments in response to public notice accepted for 15 to 30 days, unless U.S. Fish and Wildlife Service or the Environmental Protection Agency requests and are granted an extension. Comment period is not to exceed 60 days.
Public hearings usually require a separate notice; the hearing may not occur earlier than 30 days from the date of that notice.

The Corps of Engineers, Regulatory program, regulates work and structures that are located in, under or over navigable waters of the United States under Section 10 of the Rivers and Harbors Act of 1899, the discharge of dredged or fill material into waters of the United States under Section 404 of the Clean Water Act, and the transportation of dredged material for the purpose of disposal in the ocean (regulated by the Corps under Section 103 of the Marine Protection, Research and Sanctuaries Act). "Waters of the United States" are navigable waters, tributaries to navigable waters, wetlands adjacent to those waters, and/or isolated wetlands that have a demonstrated interstate commerce connection.

The U.S. Environmental Protection Agency (EPA) and the U.S. Department of the Army (Army) are announcing the withdrawal of an interpretive rule addressing the exemption from permitting provided under section 404(f)(1)(A) of the Clean Water Act (CWA). The agencies want to make clear that the statutory exemption of 404(f)(1)(A) still remains available for use when applicable for discharges of dredged and/or fill material associated with normal farming, silviculture, and ranching activities that are part of an established operation and that do not have as their purpose bringing an area of waters of the U.S. into a use to which it was not previously subject, where the flow or circulation of the waters of the U.S. may be impaired or the reach of such waters be reduced (see 33 CFR 323.4 for more information).
