Tulsa District Regulatory Permits for Public Comment

PURPOSE:  The purpose of these public notices are to inform you of a proposal for work in which you might be interested and to solicit your comments and information to better enable us to make a reasonable decision on factors affecting the public interest.

SECTION 10: The U.S. Army Corps of Engineers is directed by Congress through Section 10 of the Rivers and Harbors Act of 1899 (33 USC 403) to regulate all work or structures in or affecting the course, condition, or capacity of navigable waters of the United States.  The intent of this law is to protect the navigable capacity of waters important to interstate commerce.

SECTION 404: The U.S. Army Corps of Engineers is directed by Congress through Section 404 of the Clean Water Act (33 USC 1344) to regulate the discharges of dredged and fill material into all waters of the United States.  These waters include lakes, rivers, streams, mudflats, sandflats, sloughs, wet meadows, natural ponds, and wetlands adjacent to other waters.  The intent of the law is to protect these waters from the indiscriminate discharge of material capable of causing pollution and to restore and maintain their chemical, physical, and biological integrity.

SWT-2016-377 - 7/5/2016: The application is for the placement of fill material related to the proposed replacement of two bridges on unnamed creeks , associated with the widening of State Highway (SH) 16 in Wagoner County. The basic purpose of the proposed work (State Job Piece 24366(04)) is to replace and widen two structurally deficient Reinforced Concrete Box (RCB) bridges for public safety .

SWT-2016-257 - 6/6/2016: The application is for the placement of fill material related to the proposed replacement of the Kiamichi River Bridge, overflow bridge, and widening of US 271 in Pushmataha County.

Initial Nationwide Permit Public Notice - 6/6/2016: On June 1, 2016, the U.S. Army Corps of Engineers published in the Federal Register its proposal to reissue the 50 existing Nationwide Permits (NWPs) and issue 2 new NWPs. The Federal Register notice is the public’s opportunity to comment on the proposed NWPs, general conditions, and definitions. Comments on national issues relating to these NWPs should be submitted, identified as docket number COE-2015-0017, by any of the following methods: at www.regulations.gov, by email to NWP2017@usace.army.mil, or by mail to U.S. Army Corps of Engineers, ATTN: CECW-CO-R, 441 G Street, NW, Washington, D.C. 20314-1000. Instructions for submitting comments are provided in the June 1, 2016, Federal Register notice. Comments on the proposed NWPs are due by August 1, 2016.

SWT-0-13475 - 4/28/2016: The application is to discharge dredged and fill material into waters of the United States associated with the expansion of Long Bay Marina. The applicant proposes to gradually expand the existing 72 dock capacity to a 314 dock capacity to accommodate the needs of additional customers.

SWT-2015-775 - 4/15/2016: The application is for the placement of 65,610 cubic yards (cys) of fill material associated with the construction of South Tulsa/Jenks Low Water Dam (LWD) project and appurtenant features into the Arkansas River to facilitate a new static pool and pedestrian bridge. The proposal would also result in the construction of 7 public access features and 8 site-specific shoreline stabilization projects.
