DCMA Privacy

  1. The privacy of an individual is directly affected by the collection, maintenance, use, and dissemination of personal information by Federal agencies;
  2. The increasing use of computers and sophisticated information technology, while essential to the efficient operations of the Government, has greatly magnified the harm to individual privacy that can occur from any collection, maintenance, use, or dissemination of personal information.
  3. The opportunities for an individual to secure employment, insurance, and credit, and his or her right to due process, and other legal protections are endangered by the misuse of certain information systems;
  4. The right to privacy is a personal and fundamental right protected by the Constitution of the United States; and
  5. In order to protect the privacy of individuals identified in information systems maintained by Federal agencies, it is necessary and proper for the Congress to regulate the collection, maintenance, use, and dissemination of information by such agencies. Read more from the Defense Privacy and Civil Liberties Division.

DCMA Civil Liberties

  1. Civil liberties are fundamental rights and freedoms protected by the Constitution of the United States.
  2. Protect the privacy and civil liberties of DoD employees, members of the Military Services, and the public to the greatest extent possible, consistent with its operational requirements.
  3. Consider appropriately privacy and civil liberties in the review, development, and implementation of new or existing laws, regulations, policies, and initiatives.
  4. Not maintain information on how an individual exercises rights protected by the First Amendment to the Constitution of the United States, including the freedoms of speech, assembly, press, and religion, except when:
    • Specifically authorized by statute;
    • Expressly authorized by the individual, group of individuals, or association on whom the record is maintained; or
    • The record is pertinent to and within the scope of an authorized law enforcement, intelligence collection, or counterintelligence activity. Read more from the Defense Privacy and Civil Liberties Division.

Introduction To FOIA

Welcome to the Defense Contract Management Agency (DCMA) Freedom of Information (FOIA) and Privacy and Civil Liberties page. This office manages the policy and procedural guidance for the FOIA, and Privacy and Civil Liberties Act programs in accordance with applicable laws.

The FOIA, enacted in 1966, generally provides that any person has a right, enforceable in court, to obtain access to federal agency records, except to the extent that such records (or portions of them) are protected from public disclosure by one of nine exemptions or by one of three special law enforcement record exclusions.

This information is intended to help you make requests for agency records under the FOIA and/or the Privacy Act. It will get you started and provide you with a brief description of your rights and the manner in which DCMA will respond to your requests.

The FOIA, which is known by its legal citation as 5 U.S.C. § 552, along with the Department of Defense (DoD) Regulation 5400.7-R, "Department of Defense Freedom of Information Act Program”, governs how requests will be processed within the DoD.

DCMA established its FOIA Requester Service Center to ensure that requesters in need of assistance have a point of contact to receive status updates, as well as to answer questions and assist with any other information about their requests.
