@HouCrimLaw Haven't tried to parse verbiage but I gather #cpsia penalties will not require showing of bad intent. Isn't prison in there too?
@curiouswork Yes, that's fair; important to have a rallying point. Tell the moderate Dems to swipe & pretend it was their idea! #cpsia
Not to detract from #CPSIA hugs 4 DeMint, but: 1) he's GOP; 2) Dems run both houses; 3) we've just begun to roll stone up mountain.
@HouCrimLaw @aquinasnmore I've heard $100K is max, not min, penalty for single offense. Still terrifying enough for small operator.
@craiglaw I think D.S. would say most pitfalls (incl longer time limits) are already in place. Act "responsibly" = not get sued? Alas no.
@HouCrimLaw Yes, and stiff ones, up to $100,000.
@DHMrs Congress would not ordinarily intervene in the litigation but it could make its wishes known in other ways -- hearings, budget.
@Blynken I don't know enough to answer well. But in general, law empowers courts to second-guess agency a fair bit when it refuses to act.
RT @danielschwartz Symbolism aside, Ledbetter Fair Pay Act will have less impact than either friends or foes think http://is.gd/hQA0
First big problem with CPSC idea for 1-yr #CPSIA pause: "consumer" groups'll say it's unlawful. If/when they sue, court could nix delay.
Big #CPSIA news: CPSC may propose 1-yr delay http://bit.ly/39SG0w (PDF) & Sen. DeMint will introduce broad reform bill http://bit.ly/SA0A
Helping here: recent law grad seeks empl/labor work NY/CT or DC, also exper in insur def and alc/wine law. I'll pass leads to him
Simply awful: RT @LegalReform Stimulus bill would let state AGs file HIPAA damage suits using priv %-fee lawyers http://tinyurl.com/d6dhlu
For #followfriday, law: @nikiblack @lilyhill @annereed @carolynelefant @vpynchon. CPSIA expert: @kfasanella. Hey, where are all the men?
RT @ArsLaw Julian Sanchez on Obama regulatory pick Cass Sunstein http://ping.fm/JqynF More background @pointoflaw http://is.gd/hQ2e
RT @infogoddes Rounds up latest on books libraries & #CPSIA http://tinyurl.com/azpfkc More @rwoldenberg http://tinyurl.com/ap2mva
@aquinasnmore Awful. I just reprinted your blog post (with cite & link of course) at Overlawyered.com -- let me know if that's not OK.
@kimsch Irony is that if it's truly mass-produced, price may not rise that much. Hardest hit is small-lot, distinctive, varied, etc. #cpsia
@kimsch Some confusion about whether it applies to schools, since they don't sell items. Devastating for school supplies, in any case.
Similar law already in effect in Ontario might foreshadow how card-check unionization could work http://is.gd/hPFl #EFCAfail
