I have a feeling this is an unforseen consequence of the sheer number of content in the ID-register, and tons of fake claims.

In short, this is a system gone haywire, not actual malice. Personally, I feel this is more a case of incompetence than true evil, and I expect it to be fixed in time.

That said, I'm curious to see how Google decides to move forward. THAT is what determines how I see Youtube up ahead. Not this current debacle.

In unrelated news - windows 8 tablets have this refreshing lack of "let's integrate with social networking" and during initial setup the device is silent and plays zero trendy introductions.

"Being under a network" does not give your permission about anything.
Let's plays are not paid by ads. Youtube profits from the display of the ads and pays the video uploader a share of the profits for attracting viewers to his channel. To summarize, Let's plays are free, but the video uploader indirectly profits from them.
The majority of sales are not thanks to let's players in most cases (some small indie games greatly benefited from them) but they sure make a good portion of the full sales figures. Apart from that, many publishers are short-sighted so their behavior should not come as a surprise.
The publishers that did not tell Youtube to block the videos didn't give permission either (although they may do that whenever they want) but this doesn't make Youtube any less right in what they're doing, since using third-party content without permission is illegal nevertheless.
Twitch is not above the law If your videos are illegal on Youtube they are Illegal on Twitch as well.
