Re-delegation Limitations: The authority to initiate condemnation proceedings and execute declarations of taking shall not be further delegated. Direct a head of field organization to curtail or suspend the operation of nuclear reactors, nuclear facilities or related activities when continuing operations might result in an undue risk to the environment and/or to the safety and health of the Departmental or contractor employees or to the public may not be redelegated. Establish or discontinue organization elements at the second tier may only be redeletated to the Head of the Departmental Headquarters of Field Element. Sale or lease of real property at a DOE defense nuclear facility, make the discretionary decision of whether to hold harmless of indemnify any eligible entity, this authority may only be exercised after obtaining concurrence of General Counsel and only redelegated to Departmental officials who have been appointed by the President. Approve requests for reduction or elimination of cost sharing requirement for a research and development activity of an applied nature; approve requests for reduction of the cost sharing requirement for the non-federal share of demonstration and commercial application activites; exclude research and development of a basic or fundamental nature from cost sharing requirements may not be redelgated.
