Sex Offender Gets 46 Months for Unlawfully Possessing Firearm
BOISE – David Ray Davis, 38, of Boise, Idaho, was sentenced today to 46 months in prison for unlawful possession of a firearm, U.S. Attorney Wendy J. Olson announced. U.S. District Judge Edward J. Lodge also ordered Davis to serve three years of supervised release and forfeit the firearm he unlawfully possessed. The 46-month sentence is the most the judge could impose under the federal sentencing guidelines.
Davis pleaded guilty to the charge on January 24, 2012. According to court documents, on August 12, 1992, Davis was convicted of rape and kidnapping in the second degree in Ada County, Idaho, and sentenced to 30 years in prison. Paroled after serving part of his sentence, Davis was named a fugitive in February 2011 for absconding parole supervision. On February 11, 2011, members of the U.S. Marshals Fugitive Task Force located and arrested Davis outside a residence in Mountain Home, Idaho. At the time of his arrest, Davis was carrying a loaded 9mm semi-automatic pistol. Davis admitted in court to possessing the gun. His prior convictions for rape and kidnapping prohibit him from possessing firearms.
The case was investigated by the Treasure Valley Metro Violent Crimes Task Force and U.S. Marshals Fugitive Task Force. The case was prosecuted as part of Idaho's Project Safe Neighborhoods Program, which seeks to reduce gun violence in Idaho.
