Effective Date: The amendments made by this Act shall take effect on the date of the enactment of this Act (August 6, 2002) and shall apply to any alien who is a derivative beneficiary or any other beneficiary of--


(1) a petition for classification under section 204 of the Immigration and Nationality Act (8 U.S.C. 1154) approved before such date but only if a final determination has not been made on the beneficiary's application for an immigrant visa or adjustment of status to lawful permanent residence pursuant to such approved petition;


(2) a petition for classification under section 204 of the Immigration and Nationality Act (8 U.S.C. 1154) pending on or after such date; or


(3) an application pending before the Department of Justice or the Department of State on or after such date.

    Effective Date: Amendments to the Immigration and Nationality Act- The     amendments to the Immigration and Nationality Act made by this subtitle, and other provisions of this subtitle applying the immigration laws (as defined in section 101(a)(17) of Immigration and Nationality Act (8 U.S.C. 1101(a)(17))) to the Commonwealth, shall take effect on the transition program effective date described in section 6 of Public Law 94-241 (as added by sectio n 702(a) ), un less specifically provided otherwise in this subtitle.

FN7     Section 235(d)(7)(A) of Public Law 110-457, dated December 23, 2008, added paragraph (a)(2)(E) to section 208 of the Immigration and Nationality Act.
Effective Date This section change --
(1) shall take effect on the date that is 90 days after the date of the enactment of this Act; and
(2) shall also apply to all aliens in the United States in pending proceedings before the Department of Homeland Security or the Executive Office for Immigration Review, or related administrative or Federal appeals, on the date of the enactment of this Act.
