The basic legislative framework for commercial activity in Croatia is in place. Difficulties in implementation and enforcement arise from a variety of causes. Generally, however, these difficulties can be traced to a lack of practical experience in interpreting and applying these laws. Two areas are of immediate concern:

Bulgaria Assessment

This information comes from the assessment conducted in country for the Bulgaria report, which was published in March 2002. The Bulgarian insolvency legislation bends over backward to include every possible opportunity for creditor participation. However, this attempt at ultimate fairness undermines the system’s effectiveness, generating lengthy, unnecessary litigation, numerous delays due to excessive exercise of appeal rights, and inconsistent legal standards for major issues such as valuation.

Armenia Assessment

This information comes from the assessment conducted in country for the Armenia report, which was published in December 2001. The commercial, legal, and institutional environment in Armenia can currently be characterized as a system of parallel worlds in which reforms and progress move in different directions at different speeds. Basic laws range from quite good to nonexistent, supported by institutions that vary from excellent to deplorable. Widely divergent experiences of investors in navigating the system belie an unstable rule of law.

Albania Assessment

This information comes from the assessment conducted in country for the Albania report, which was published in September 2000. The Republic of Albania emerged nine years ago from over 44 years of isolation from the world economy and culture. Emerging from its self-imposed cocoon, Albania entered the modern world with only minimal understanding of, and preparation for, democratic government and market economics. The international community was quick to supply aid and technical assistance as the formerly controlled economy fell apart and Albania began to find its way.
