ARRANGEMENT ESTABLISHING AN ALLIANCE BETWEEN
THE UNITED STATES DEPARTMENT OF LABOR’S OCCUPATIONAL SAFETY
AND HEALTH ADMINISTRATION, KANSAS CITY AREA OFFICE
AND
THE UNITED STATES DEPARTMENT OF LABOR’S WAGE AND HOUR DIVISION, KANSAS CITY DISTRICT OFFICE
AND
THE CONSULATE OF MEXICO IN KANSAS CITY, MISSOURI
The United States Department of Labor’s Occupational Safety and Health Administration (OSHA), Kansas City Area Office; the United States Department of Labor’s Wage and Hour Division (WHD), Kansas City District Office; and the Consulate of Mexico in Kansas City, Missouri (the Consulate), hereinafter referred to collectively as “the Parties”,

Recognizing the joint commitment to workplace safety and health protections acknowledged in the 2004 Letter of Agreement between the Department of Labor of the United States and the Ministry of Foreign Affairs of the United Mexican States; and

Recognizing that OSHA’s Alliance Program provides for the establishment of cooperative relationships for purposes such as training and education, outreach and communication and promoting a national dialogue on workplace safety and health;

Intend to establish an Alliance to achieve the following:

Overall Objective

The Parties intend to establish a collaborative relationship to provide information, guidance, and access to training resources that is expected to help protect employees’ health and safety, particularly in reducing and preventing exposure to falls, noise and other safety hazards. The intention of this relationship is also to provide education on labor issues, such as minimum wages and proper overtime compensation.

Training and Education

The Parties intend to work together to achieve the following training and education goals:
  • To develop training and education programs for Mexican Nationals regarding workers’ rights in occupational safety and health (including but not limited to fall hazards, hazards related to construction, meat processing and migrant farming), proper minimum wage, overtime compensation, migrant and seasonal worker protections and youth employment.

  • To deliver or arrange for the delivery of training concerning fall protection, personal protective equipment, ergonomics, minimum wage, overtime, child labor, migrant and seasonal worker protections, and hazard recognition.

  • To develop workplace safety and health curricula on hazards faced by Mexican Nationals working in Missouri.
Outreach and Communication

The Parties intend to work together to achieve the following outreach and communication goals:
  • To develop information on the recognition and prevention of workplace hazards, youth employment rules, wage compensation rights and other migrant and seasonal work protections, and to develop ways of communicating such information (e.g., print and electronic media, including electronic tools and links to OSHA’s and WHD’s web sites from the Consulate’s web site) to employers and employees in the construction, meat processing and migrant farm industries, in English and Spanish.

  • To speak, exhibit, or appear at the Parties’ conferences, local meetings, or other mutually agreed upon events.

  • To share information among OSHA personnel and industry safety and health professionals about the Parties best practices or effective approaches and through the Parties’ developed materials, training programs, workshops, seminars, and lectures (or any other applicable forum).

  • To promote and encourage the Parties’ or worksites’ participation in OSHA’s cooperative programs such as compliance assistance, the Voluntary Protection Program, Consultation Program, and the Safety and Achievement Recognition Program.

  • To work with other Alliance participants on specific issues and projects on safety and health hazards, working conditions and labor rights throughout various industries for Mexican Nationals that are addressed and developed through the Alliance Program.

  • To encourage the Parties and Mexican Nationals to build relationships with OSHA’s Regional and Area Offices to address safety and health hazards, minimum wage, overtime, child labor and migrant and seasonal worker protections in English and Spanish.
Promotion of a National Dialogue

The Parties intend to work together to achieve the following goals related to promoting a national dialogue on workplace safety and health and proper wage compensation:
  • To raise awareness of and demonstrate commitment to workplace safety and health and workers’ employment rights whenever leaders from the Parties address groups.

  • To convene or participate in forums, round table discussions, or stakeholder meetings on issues affecting Mexican Nationals to help forge innovative solutions to issues concerning workplace safety and health, proper wage compensation, and other employment issues.
An implementation team made up of representatives from the Parties intends to meet to develop a plan of action, determine working procedures, and identify the roles and responsibilities of the participants. In addition, the Parties intend to meet at least one time per year to track and share information on activities and results in achieving the goals of the Alliance.

This Arrangement is to remain in effect for two years from the date of signing. This Arrangement may be modified in writing by mutual consent of the Parties, specifying the effective date of any modifications. Any of the signatory Parties may, at any time, terminate this Arrangement by written notification to the others, with thirty (30) days notice.
