[DOE LETTERHEAD]

July 27, 2006

The Honorable A. J. Eggenberger

Chairman

Defense Nuclear Facilities Safety Board

625 Indiana Avenue, NW, Suite 700

Washington, DC 20004-2901

Dear Mr. Chairman:

On July 21 , 2006, we met with members of the Defense Nuclear Facilities Safety Board (Board) staff to discuss our June 8, 2006, letter providing resolution of Board comments on the Department’s draft manual DOE M 441.1-1, Nuclear Material Packaging Manual.  As a result of this meeting, we believe that two issues dealing with the development of a new packaging manual in response to Board Recommendation 2005-1 need more discussion between our staffs before the draft manual is finalized.  The two issues involve (1) how the manual interfaces with in-process activities and (2) the use of DOE STD 3010 in this manual.  Until these staff discussions are completed, the Department’s response to your comments 1 and 2 is rescinded.

In addition, since these discussions are related to and may impact on our resolution of comment 10 in our July 21, 2006, letter to you regarding Repacking Methodology, the Department’s response to comment 10 is also rescinded.

If you have any questions, please call me at (202) 586-6151 or Rich Stark at (301) 903-4407.

Sincerely,

C. Russell H. Shearer

Acting Assistant Secretary for
